Terms of Service

1. Company Information

1.1 CryoGames is operated by EliteGames s.r.o., registered in the Slovak Republic (IČO: 56425392), with registered office at Revolučná 868/6, 01001, Žilina, Slovakia. Contact: support@cryogames.net.

2. Scope of Services

2.1 CryoGames sells digital video game accounts and related services. Products are delivered digitally to the buyer's email or via the Website after payment.

2.2 Accounts may be subject to the terms and policies of the respective game publishers. CryoGames is not affiliated with, endorsed by, or connected to any official game developer or publisher.

3. Definition of Digital Content

For the purposes of these Terms of Service, “Digital Product” or “Digital Content” means data produced and supplied in digital form, including but not limited to software, subscriptions, licenses, downloadable files, online services, and access to digital platforms.

4. Delivery of Digital Products & Activation Instructions

4.1 Digital Products (including access credentials or activation keys) are delivered electronically, typically instantly after successful payment, either via email or through the user's account on the Website.

4.2 In exceptional cases, delivery may take up to 24 hours. If the Product is not delivered within this time, the customer must contact customer support at support@cryogames.net.

4.3 Activation instructions are provided together with the Product. The customer is responsible for following these instructions accurately. If activation fails due to a technical issue on our side, the customer is entitled to support, correction, or replacement.

5. No Refunds After Delivery

Once the Digital Product has been:

   • Delivered,

   • Downloaded,

   • Activated, or

   • Accessed in any way,

no refunds will be issued, as digital content cannot be returned and cannot be verified as unused, except in cases of defective Digital Content as defined by law.

6. Exceptions – Defective Digital Content

The consumer may be entitled to remedies if the Digital Product:

   • Is defective,

   • Does not function as described, or

   • Is not provided in accordance with the contract.

In such cases, the consumer has the right to:

   • Request repair or correction,

   • Request replacement,

   • Request a reasonable price reduction, or

   • Withdraw from the contract, if the defect is substantial and cannot be remedied.

These rights are governed by Act No. 108/2024 Coll. on Consumer Protection for Digital Content and Digital Services.

7. Chargebacks and Payment Disputes

Unauthorized chargebacks or payment disputes initiated after delivery of the Digital Product may be considered a breach of these Terms of Service. We reserve the right to suspend or terminate access to our services in such cases.

8. Warranties and Liability

8.1 CryoGames guarantees that Products will be delivered as described (valid login credentials).

8.2 We are not responsible for bans, suspensions, or restrictions placed by game publishers after delivery. CryoGames is not liable for any indirect, incidental, or consequential damages. Our liability is limited to the purchase price paid for the Product.

9. Prohibited Use

9.1 You agree not to: use the Website or Products for unlawful purposes; attempt to resell Products without our permission; or use the Website in a way that harms CryoGames or other users.

10. Account Security

10.1 Once the Product is delivered, you are responsible for securing and changing login details. CryoGames is not responsible for losses due to your failure to secure your account.

11. Privacy & Data Protection

11.1 CryoGames processes personal data in compliance with GDPR (EU Regulation 2016/679) and Slovak data protection laws. For details, please see our Privacy Policy.

12. Alternative Dispute Resolution

12.1 If the consumer is not satisfied with the way we handled a complaint, they may submit a request for alternative dispute resolution (ADR) to the Slovak Trade Inspection (SOI).

13. Changes to Terms

13.1 CryoGames may update these Terms at any time. Updated versions will be posted on the Website with a new "last updated" date. Continued use of the Website means you accept the updated Terms.
